[abandoned] The Hideously Political Ethical Licence

[EDIT 2021-02-03: I was reminded shortly after the last edit that HD's code is derivative of the GZDoom source and has to be GPL anyway. The only things I'd be able to get away with putting under a licence like what I've got here is story and art that (1) isn't likely to be stolen by chuds anyway; (2) where it would be is public-domain source stuff that they've already taken and I'm trying to reclaim; or (3) I'd be much better off taking more energy to write and design in such a way that better gets the underlying values across.]

[EDIT (same day as OP): This is going to interact poorly with the Freedoom stuff. Staying BSD for now, though this was an interesting thought experiment.]


Now that I'm reviewing the HD distribution licence anyway, and given how easily this sort of project can be used for nefarious purposes, I'm thinking of moving away from a proper FLOSS licence in favour of something less inherently chaotic.

So here's an attempt, felt legalistic might delete later:

The Work may be distributed or used as the basis for any derivative work as long as:

  1. GENERAL

1.1. it includes these terms, whether by direct inclusion or by reference.

1.2. any derivative work is identifiably indicated to be based on the Work.

1.3. any distribution includes some means by which an unsophisticated end user may access the last known official download for the Work.

1.4. no contributor to the Work is shown to be endorsing, and neither the name, image nor imagery of the any such contributor is used to endorse, any product, service, belief or ideology whatsoever, except with that person's express consent.

1.5. no abridged, censored, expanded or otherwise altered or modified version of any portion of the work is indicated (including by omission) to be an unaltered whole or part of the originating Work.

  2. POLITICAL

2.1. it is not used, and it is not distributed in a manner that is used, to manipulate users or others into divulging personal information or identifying or tracking data or metadata to which they have not given their informed, explicit, adequately considered consent.

2.2. it is not celebrating, inciting, encouraging, or simulating for the purpose of enabling, the killing, injury or harassment of any person (named or unnamed, living or dead, fictional or otherwise) except in such person's capacity as an imminent proportional threat to the protagonist or an active combatant in an explicitly violent conflict, which conflict must not be reasonably identifiable as a likely allegory for any allegedly real-life conspiracy theory about Jews, Catholics, Muslims, immigrants, any LGBTQIA+ community or similar.

2.3. it is not used in any way for the purpose of, or which has the effect of, disparaging or counselling discrimination against any person on the basis of their race, ethnicity, skin colour, caste, religion (except to the extent necessary to discriminate against any prohibited group as defined below), sexual orientiation, gender identity/presentation or disability.

2.4. it is not associated with and does not feature or promote any of the following groups, organizations or ideologies or their successors or affiliates ("prohibited groups"), or any symbols, slogans, iconography or other identifiers thereof, except to identify an adversary that is unequivocally to be opposed or removed from power: the Nazis, the Ku Klux Klan or any successor, similar or sympathetic white supremacist or white nationalist organization or ideology; al-Qaeda, the Taliban; the Recording Industry Association of America; the Islamic State of Iraq and the Levant; QAnon; the Proud Boys; the Republican Party of the United States of America or any of its states; the Communist Party of the People's Republic of China; the Conservative Party of Canada; the Conservative Party of the United Kingdom; the North American Man/Boy Love Association or any sort of "MAP"-enabling ideology; the Church of Scientology; People for the Ethical Treatment of Animals; Autism Speaks; any homeowners' association; any police union (as distinct from a police department or force).

2.5. nothing in this Licence respecting prohibited groups serves to prohibit the following from distributing, using or modifying the Work in accordance with the balance of this Licence:
(a) individuals who happen to be members, affiliates or sympathizers of one or more prohibited groups, acting on their own without any apparent association with any prohibited groups; and
(b) members of groups unconnected to any prohibited groups, which unconnected groups happen to have a historical connection to similar identifiers that would have remained had the prohibited groups also using them never existed, at all times using such identifiers in good faith solely to represent their own unconnected groups.

- be used to train any LLM or other software popularly known as "AI"
- endorse any political or religious belief that opposes abortion, vaccination against disease, gender-affirming treatment of any consenting person of any age, or the modern post-Darwin-Wallace consensus on the theory of evolution

For any jurisdiction listed below, substitute Ontario, Canada instead:
